1. What type of Bond do I need?

Applicants can submit either a letter of credit or Surety Performance Bond.

Both the City of Shasta Lake and pending language in the State of California SB 94 requires applicants to provide proof of a bond to cover the costs of destruction of cannabis or cannabis products if necessitated by a violation of licensing requirements. The City of Shasta Lake will require a $5,000 Surety Performance Bond, most likely the State will require the same.

2. For retail, can the employee name tags reflect just first name and photo ID?

Yes. All employees of the dispensary (retail) must wear photo identification badges clearly identifying them as employees. Badges must have a frontal face picture, be at least 2"x 2" and of passport picture quality. It is up to the dispensary owner's internal policy on style and name criteria.

3. Is there a limit to the number of licenses a cannabis business can obtain?

The City does not have a limit on the number of cannabis permits a business can hold. However, it is important to check State regulations for both the Medical Cannabis Regulation Safety Act (MCRSA) and Adult Use of Marijuana Act (AUMA) or Prop 64 for potential State limits on the number and license combinations a cannabis business can hold.

4. How long does the application process take? Will I be notified if my application is not complete?

If any of the items listed in the application process are not met, the Director shall notify the applicant of the deficiency within 10 working days, after which the applicant will have 10 working days from the receipt of the notice to correct the deficiency. If the deficiency is not corrected within 10 days, the Director may deny the permit and notify the applicant of this determination in writing within 10 calendar days following the directors decision after which the applicant can appeal the decision in accordance with 5.05.120.

5. Can a cannabis business be a commercial operation?

No. Until a cannabis business is licensed by the State of California, the business cannot commercially operate a cannabis business for profit. The State does not anticipate issuing licenses before January 2018. Without a State license, a cannabis business must operate as a cooperative or a collective of four or more qualified patients, primary caregivers, or persons with a medical marijuana identification card.

6. How do I know if a cannabis business is allowed on the property where I plan to operate?

7. Can I cultivate cannabis while my permit applications are being processed?

No. With the exception of Registered Applicants (see below), cannabis cultivation may not begin on the property until all required permits have been approved -- even if your applications have been submitted and are being processed.

8. Is there a cap to the number of permits the City will issue?

There is currently no cap to the number of permits the City will issue. However, this can change due to a number of factors, which may include the availability of land or properties, or the number of existing cannabis businesses in the City.

9. Does the City allow commercial cultivation and manufacturing for non-medical purposes now that the voters passed Prop. 64?

No. Commercial cultivation and manufacturing for non-medical purposes is prohibited by State law without a State license. The State does not anticipate issuing licenses until January 2018. Currently, Prop. 64 allows the personal cultivation of up to six living cannabis plants inside a person's private residence.

12. Does the City of Shasta Lake allow “Cottage Licenses” for commercial cultivation?

Yes.

Cottage Licenses are covered under the following type:
Type 1C: Specialty Cottage – up to 25 mature plants for outdoor; up to 500 sq ft for indoor; or up to 2,500 sq ft for mixed-light.

The City of Shasta Lake’s Application for Cultivation Permit, under Indoor/Mixed Light, Commercial A – is allowed for up to 5,000 sq ft of cultivation area, the cottage license would be covered under this license type.

Please note: Commercial Outdoor cultivation is not permitted in the City of Shasta Lake, indoor and mixed-light is available.

13. According to City's cannabis ordinance dispensaries and Retail outlets are permitted to deliver, does this apply to retail nurseries?

Nurseries cannot sell retail. If they get a distributors license they can deliver to other commercial cannabis businesses.
